Terms of service
Short version. Use Fifths to train your ear. Don't abuse the service or try to break it. Subscriptions auto-renew until you cancel — refund within 14 days if you change your mind. We try to keep things working but make no warranties. Questions: hello@fifths.io.
1. Who you're agreeing with
"Fifths," "we," "us," and "our" mean Ketabian LLC, the operator of the Fifths ear training service ("Service"), reachable at hello@fifths.io. By accessing the website at fifths.io, the web app at app.fifths.io, or any future iOS or Android app, you agree to these Terms. If you don't agree, please don't use the Service.
2. The service
Fifths is an ear-training application that helps you practice intervals, chords, scale degrees, and related musical skills. We may add, change, or remove features at any time. The free tier gives you a generous slice of the curriculum; paid subscriptions ("Pro") unlock additional lessons and analytics.
3. Your account
You can use the free tier without an account. To purchase a subscription, sync practice data across devices, or access certain Pro features, you'll sign in with an email address (magic link) or a third-party identity provider such as Google or Apple. You're responsible for keeping access to your sign-in email secure. Don't share access to a single account with multiple people — each user should have their own account.
You must be at least 13 years old to create an account. If you're under 18, you may only use the Service with the involvement of a parent or guardian.
4. Subscriptions, billing, and refunds
Pricing
Current pricing is shown in-app on the paywall. As of this update: Pro Monthly is $4.99/month, Pro Annual is $39.99/year, and Lifetime (limited to the first 100 customers) is $99 one-time.
Auto-renewal
Monthly and annual subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date. You can cancel anytime from inside the app or by emailing hello@fifths.io.
Refunds
If you're not satisfied within 14 days of your first paid charge, email hello@fifths.io for a full refund. After 14 days, monthly and annual subscriptions are non-refundable, but you can cancel renewal at any time and keep Pro access until the end of your billing period. Lifetime purchases are refundable within 14 days of purchase.
Purchases made through Apple App Store or Google Play follow each store's refund policy in addition to the above.
Payment processing
Web payments are processed by Stripe via RevenueCat. Mobile payments (when iOS and Android apps launch) are processed by Apple or Google. We don't see or store your payment card details.
5. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code or audio assets of the Service, except as expressly permitted by law.
- Scrape, mass-download, or republish content from the Service without written permission.
- Share, resell, or sublicense your account access.
- Use the Service to harass others, transmit malware, or violate any applicable law.
- Probe or attack the Service's infrastructure, including denial-of-service attacks, brute-force attempts, or attempts to access another user's data.
6. Intellectual property
We own the Service, including the curriculum, software, brand, audio samples (where licensed), and content we create. Your right to use it is a limited, non-transferable license that lasts as long as your account is in good standing.
You own your own practice data. We won't claim rights over the audio you sing or the answers you give in sessions; we only process them to provide the Service and the analytics you see.
7. Privacy
Our handling of your data is described in the Privacy Policy, which is incorporated into these Terms by reference. The short version: we collect what's needed to run the Service, we don't sell your data, and you can request deletion at any time.
8. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee that the Service will be uninterrupted, error-free, or that it will improve your musical ability by any specific amount.
9. Limitation of liability
To the maximum extent allowed by law, Ketabian LLC's total liability for any claim arising out of these Terms or your use of the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) US $50.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we've been advised of the possibility.
Some jurisdictions don't allow the exclusion of certain warranties or the limitation of liability for certain damages — in those cases, the limitations above apply only to the extent permitted by law.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your account if you breach these Terms or use the Service in a way that harms us, other users, or third parties. On termination, your right to use the Service ends immediately. Refund eligibility is governed by Section 4.
11. Changes to these terms
We may update these Terms from time to time. If we make material changes, we'll update the "last updated" date at the top and, for substantive changes, notify subscribers by email. Continued use of the Service after the change means you accept the updated Terms.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles. Any dispute arising out of these Terms will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. If you're a consumer in the EU, UK, or another jurisdiction with mandatory consumer protections, nothing in this section limits your statutory rights.
13. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. You may not assign these Terms without our written consent; we may assign them as part of a merger, acquisition, or sale of assets.
